Privacy Policy

This Privacy Policy by HEAL DIABETES CLINICS, INC. (“we”, “us”, “our”) explains how we collect, use, share and protect information about you; and your choices concerning the use of such information. At some times “we”, “us” and “our” may include our “Affiliates”, which are entities that we fully or partially own, or that we fully or partially manage under a management services agreement; and our “Contractors”, which are individuals and entities we have contracted to provide you, our Affiliates or us with clinical, coaching, educational, editorial, sales, marketing, support, technical, management or operational services and products.

This Privacy Policy governs (a) the products, services, features, information, tools and resources that we provide either for free or for a fee at the website, other online services, and mobile devices (“HEAL Digital Products”); and (b) personal services we offer both privately and publicly ((a) and (b) individually and collectively, “HEALcare”).

By using, participating in, registering for, purchasing or subscribing to HEALcare (“Using HEALcare”), you agree to the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you should not Use HEALcare.

Please refer to this Privacy Policy on a regular basis. We will post on HEAL Digital Products all changes to this Privacy Policy. If a change to this Privacy Policy significantly modifies our use of your information, we will personally notify you by email or otherwise, and you will have the option to authorize us to use your information in the new manner.

“Your Information” consists of “Personally Identifiable Information” and “Non-Personally Identifiable Information”.

“Personally Identifiable Information” is information that can be used to identify or contact you, including but not limited to your name, postal address, email address, telephone number, birth date, certain medical and health data, and billing and payment information.

“Non-Personally Identifiable Information” is information that by itself cannot be used to identify or contact you, including but not limited to age, occupation, education, gender, and certain medical and health data. It may also include information about your installation and Use of HEALcare, such as IP addresses, web browser types, domain names, device configuration, software configuration, time stamps, and other anonymous data.

Information from children under 13 years of age

HEALcare is not designed for or directed to children under the age of 13. We do not collect Personally Identifiable Information from any person we know is under the age of 13. We urge parents or guardians to participate in their children’s exploration of the Internet, and to teach their children about protecting their personally identifiable information.


We apply industry-standard policies, procedures and technologies to keep Your Information as safe as technically and operationally possible from loss, misuse, or unauthorized access and alteration.

We store Personally Identifiable Information on servers located in controlled, secure environments, protected from unauthorized access. We transmit Personally Identifiable Information using Secured Socket Layer (SSL) encryption or similar technologies.

We grant our employees, Affiliates and Contractors access to Your Information on a need-to-know basis to the extent that it is reasonably necessary for them to perform their functions for us. We require that they abide by this Privacy Policy, are kept up-to-date on security practices, and not use or disclose Your Information for any purpose other than providing us with products or services for which they are employed or contracted. Anyone who violates this Privacy Policy is subject to disciplinary action, up to and including termination.

We cannot warrant complete security because there is always the risk that third parties can thwart any security system. Therefore, you provide us with Personally Identifiable Information at your own risk.


General terms of collection and use

We will only collect, use and share Your Information for the purposes described in this Privacy Policy or as otherwise disclosed at the time we collect information from you.

We collect Personally Identifiable Information that you voluntarily provide us in different manners, places and times while Using HEALcare. This includes when communicating in writing or orally with us; and submitting enrollment and subscription forms, surveys, questionnaires, self-assessments, quizzes, contests, sweepstakes, and the like. We may combine Personally Identifiable Information with information obtained from other legitimate sources, including but not limited to our internal usage logs and third-party databases.

You do not have to provide us with Personally Identifiable Information to Use free versions of HEALcare. However, if you choose to withhold certain Personally Identifiable Information, you may not be able to Use all features of HEALcare, such as purchasing or subscribing to fee-based services and products, or posting content to our “Forums” such as blogs, personal pages, group pages, chat rooms, message boards, bulletin boards, and recipe swaps.

We generally use Your Information to deliver, administer, monitor and improve HEALcare. This may include but not be limited to personalizing and facilitating your Use of HEALcare; understanding who uses HEALcare and how it is used; and conducting marketing campaigns.

With the exceptions set forth in this Privacy Policy, we will obtain your permission before using or disclosing Personally Identifiable Information. We may use Non-Personally Identifiable Information at our sole discretion, including sharing it with third parties such as prospective and actual advertisers and sponsors, commercial partners, prospective and actual licensees, prospective Affiliates, prospective Contractors, and researchers.

Creating a HEALcare Account

To purchase or subscribe to HEALcare you must create and periodically update a “HEALcare Account”, which may require you to provide certain Personally Identifiable Information and Non-Personally Identifiable Information.

Cookies and other tracking technologies

HEAL Digital Products use cookies, beacons and similar web-based tracking technologies that produce Non-Personally Identifiable Information but we may link this information to Personally Identifiable Information.

We contract with third parties to display advertising and syndicate content on HEAL Digital Products, and to manage our advertising and syndicated content on third-party websites and other online and mobile services. These third parties may use technologies such as cookies to gather Non-Personally Identifiable Information so they can provide you with advertising and content based upon your browsing activities and interests. We may receive reports on the use of these technologies from these third-party companies on an individual and aggregate basis.

Some web browsers incorporate a “Do Not Track” feature and “ad blockers” that signal to websites that you do not want to have your online activity tracked or advertising displayed. We do not interpret or respond to “Do Not Track” signals, but you can customize how your web browser accepts and manages cookies. If you reject cookies or use ad blockers, you may still Use HEALcare but some of its features may be partially or completely limited.

Communicating with you

You may “opt-in” to receive email from us containing information that may be of interest to you. If you no longer desire to receive this communication, we will provide you with an option to change your preferences.

We may send you email to communicate important non-promotional announcements about the Use of HEALcare. If you do not wish to receive these announcements, you may cancel your HEALcare Account and delete your Personally Identifiable Information.

If you identify yourself to us when contacting us with questions or comments, we may use Your Information to respond and we may file your questions or comments for future reference.

We may communicate with you telephonically or by postal mail unless you notify us that you do not desire to receive our telephonic or postal communication.

Social media platforms

HEAL Digital Products may contain social-media “Features” to facilitate your interaction and sharing of information with third-party social media platforms including but not limited to Facebook, Twitter, Instagram and Pinterest. Features are either hosted by third-party platforms or directly by us. Features may collect Non-Personally Identifiable Information, and may set cookies to enable Features to function properly. These cookies may allow the social media platform to link the foregoing data with your HEALcare Account and your profile in the third-party social media platforms. We are not responsible for the privacy practices of such social-media platforms; you must refer to their privacy policies.

Linking your HEAL Account with third-party applications and devices

HEAL Digital Products may offer you the option to connect your HEALcare Account with third-party “Apps” like diet diaries, medical devices, and devices that measure your physical activity. If you link your HEALcare Account with an Apps account, we notify the Apps third-party provider that you have a HEALcare Account and some data collected by the third-party provider may be transferred to us and incorporated into your HEALcare Account. You may disconnect Apps from your HEALcare Account at any time. We are not responsible for the privacy practices of such third-party Apps providers; you must refer to their privacy policies.

Referral programs

We pay commissions to entities, individuals and websites that refer prospective customers to us. We track the Use of HEALcare to determine who has earned a commission and the effectiveness of our referral program. Referrers do not receive Personally Identifiable Information from us.

If you apply to become or become a referrer, we use the data you provide strictly for conducting business with you. Should you become a referring website through a third-party referral program operator, we are not responsible for its privacy practice; you must refer to their privacy policy.


Our Forums allow you to communicate with other HEALcare users, and to disclose information about yourself including, if you elect, Personally Identifiable Information.


Email or refer a friend

The referral tools in HEAL Digital Products send email to your friends at your request. The referral tools will collect Personally Identifiable Information about your friends such as their names and email addresses. We may store this information for sending the requested email, following up, and operating and tracking the success of our referral program. We will not use your friends’ information for any other purpose. Your friends may contact us to request that we delete their information.


With your explicit consent, we may post testimonials from you along with your name on HEALcare and our marketing material.

Third-party content and websites

HEAL Digital Products contain content syndicated from and links to third-party websites not owned or operated by us, such as educational articles embedded in HEAL Digital Products and websites that you visit after clicking on banner ads in HEAL Digital Products. When necessary, we will attempt to make it obvious when you are shown such content or leave HEALcare to visit these third-party websites. We are not responsible for the privacy practices of such third-party websites; you must refer to their privacy policies.

Third-Party Information Systems

We may transfer some of Your Information to secure “Third-Party Information Systems”, some that may be cloud-based, that we use to run our company and manage and deliver HEALcare. These include but are not limited to electronic medical records systems, customer-relationship management systems, web analytics and logging systems, sales and marketing management systems, email management systems, PCI-compliant payment processing systems, event management systems, third-party databases, and document-storage repositories. We treat the information we store in these Third-Party Information Systems like we treat information stored in our internal systems, and make reasonable effort to ensure that their privacy and security policies are at least as strict as ours.

Third-Party Vendors

Through your Use of HEALcare you may purchase products and services and obtain information from “Third-Party Vendors”. We will attempt to make it clear when you are dealing with a Third-Party Vendor. Third-Party Vendors may request that we share Personally Identifiable Information, which we will do only after receiving your permission. You do not need to approve this sharing of information to continue Using HEALcare. We are not responsible for the privacy practices of Third-Party Vendors; you must refer to their privacy policies.

Compliance with laws, regulations, legally compelled disclosures, and litigation

We may disclose Personally Identifiable Information if we reasonably believe in good faith that it is necessary to (a) comply with an applicable statute, regulation, rule or law, subpoena, search warrant, court or regulatory order, or other valid legal process; and (b) identify, contact or bring legal action against someone who may be violating HEALcare’s terms of service or to protect our safety and security, or the safety and security of our users or the public.

Sale of business

We have the right to transfer at our sole discretion Your Information to a third party in the event of bankruptcy, sale, merger, or other transfer of all or substantially all our company’s assets if the third party agrees to adhere to the terms of this Privacy Policy. We will promptly notify you of any such transfer.


You can review, change or delete Personally Identifiable Information by accessing the appropriate settings in HEAL Digital Products or contacting us.

We may retain certain Personally Identifiable Information for purposes allowed by law, to continue providing HEALcare to you, and to comply with our legal obligations. Deleting your entire Personally Identifiable information may affect our ability to provide HEALcare to you and manage your opt-out wishes.

It may not be technically possible to delete every piece of Personally Identifiable Information from all systems, including Third-Party Information Systems. For example, the need to back-up systems to protect information from inadvertent loss means that certain archived Personally Identifiable Information may be impossible for us to find and delete.

Changes and deletions of Personally Identifiable Information may not affect information that we may have provided to third parties in accordance with this Privacy Policy prior to any such change or deletion.
